A person born to a R.O.C. national parent is a R.O.C. national at birth. A person born in the territory whose parents cannot be ascertained or were both stateless is also a national. Birth in Taiwan alone to identified foreign parents is not general jus soli.

A foreign national or stateless person domiciled in the R.O.C. may apply for naturalization after legally residing more than 183 days each year for at least five consecutive years, with capacity, good conduct, livelihood, and basic national-language and civic knowledge. Shorter three-year floors apply for spouses, certain family ties, persons born in the territory, and other Article 4 categories. Permission is granted by the Ministry of the Interior; eligibility is not an entitlement.
