Citizenship at birth through a Slovak parent or on Slovak territory
Birth to a Slovak parent creates Slovak citizenship (Act 40/1993 Β§ 5(1)(a)). Birth on Slovak territory ALSO confers it in two cases: Β§ 5(1)(b) where the parents are stateless, and Β§ 5(1)(c) where the parents are foreign nationals and the child acquires the citizenship of neither of them at birth. Β§ 5(2) goes further and presumes Slovak citizenship for a child born on the territory, or found there with unknown parents, unless foreign citizenship is proved. This is conditional jus soli of the statelessness-safeguard type, not the absence of jus soli.
