Citizenship at birth through a Slovak parent or on Slovak territory

Birth to a Slovak parent creates Slovak citizenship (Act 40/1993 § 5(1)(a)). Birth on Slovak territory ALSO confers it in two cases: § 5(1)(b) where the parents are stateless, and § 5(1)(c) where the parents are foreign nationals and the child acquires the citizenship of neither of them at birth. § 5(2) goes further and presumes Slovak citizenship for a child born on the territory, or found there with unknown parents, unless foreign citizenship is proved. This is conditional jus soli of the statelessness-safeguard type, not the absence of jus soli.

Naturalization as the spouse of a citizen

A spouse of a Slovak may naturalize after permanent residence and about five years in a common household, instead of eight years of permanent residence.

Slovak citizenship through a Slovak parent

A child of a Slovak citizen parent is Slovak, and restoration routes cover former Czechoslovak and Slovak citizens. From 15 July 2026 a new §7(8) lets anyone with a parent, grandparent or great-grandparent who was a Czechoslovak citizen born in present-day Slovakia apply without the eight-year permanent-residence condition, needing no Slovak residence permit and no language test. The grant remains discretionary.

Naturalization after eight years permanent residence

Adults generally need eight years continuous permanent residence immediately before applying, Slovak language knowledge, livelihood, and good conduct. Shorter paths exist for spouses and some descent categories. Grant is discretionary.
