Citizenship at birth through a Malaysian parent

Art. 14 and Second Schedule Part II: persons born on or after Malaysia Day are citizens by operation of law if born in the Federation with at least one parent a citizen or permanently resident; or born abroad to a citizen father under the registration/service rules of Second Schedule Part II ss. 1(b)โ€“(c); or born in the Federation not a citizen of any other country (ss. 1(e)). Not unrestricted jus soli for two foreign parents.

Citizenship by registration for the foreign wife of a Malaysian citizen

Art. 15(1): a married woman whose husband is a citizen is entitled, on application, to be registered as a citizen if she has resided in the Federation throughout the two years preceding the application, intends to do so permanently, and is of good character (subject to art. 18). Foreign husbands of Malaysian women have no parallel art. 15 registration track.

Malaysian citizenship through a Malaysian parent

Descent is primarily father-line for births abroad (Second Schedule Part II s. 1(b)โ€“(c), with consular registration within a year unless the father was born in the Federation or is in federal/state service). Births in the Federation need at least one citizen or permanently resident parent (s. 1(a)). Maternal transmission alone for foreign births is not the general automatic rule.

Naturalization after long residence

Art. 19 naturalization: the Federal Government may grant a certificate if satisfied of good character, adequate knowledge of the Malay language, and residence for periods amounting in the aggregate to not less than ten years in the twelve years immediately preceding the application, including the twelve months immediately preceding that date (art. 19(3)). Highly discretionary; dual citizenship is not generally permitted.
