Naturalization as the spouse of a citizen

Art. 16(1) reduces the permanent-residence condition for applicants married to a Kazakhstan citizen for at least three years (состоящие в браке … не менее трех лет) — the three years attach to the marriage duration, not to “three years of residence instead of five.” Still a presidential discretionary admission track.

Kazakhstani citizenship through a Kazakhstani parent

Not unconditional single-parent jus sanguinis. Art. 11: a child both of whose parents are citizens is a citizen regardless of birthplace. Art. 12 covers mixed-parentage cases with additional conditions (birth in Kazakhstan, consent, or other statutory cases). The prior “any one Kazakhstani parent, any birthplace” wording overstates art. 11.

Naturalization after about five years residence

Admission to citizenship under art. 16(1) for persons permanently residing in Kazakhstan on lawful grounds for not less than five years, or married to a Kazakhstan citizen for not less than three years (the three-year figure is the duration of the marriage, not a separate three-year residence track). Dual citizenship is not recognized (art. 3). Grant is by the President (art. 15) and discretionary.
