Residence permit for an employee under the Residency Regulations 2026 (LN 2026/166), made under ss. 13 and 43(7) of the Treaty on Gibraltar and the European Union Act 2026 and in force 14 July 2026. Regulation 5(2) provides that the permit "grants the holder the legal right to reside in Gibraltar". Regulation 7(1) requires an employment contract of no less than one year under which gross annual earnings are no less than the average gross annual earnings in Gibraltar; an employer trading in Gibraltar and fully licensed under the Fair Trading Act 2023 (or otherwise regulated) and up to date on payments and filings; evidence of a purchase or rental agreement for property in Gibraltar, which may be conditional on the grant; an applicant aged 55 or under; and full vetting by the authorities of the country of most recent habitual residence. The earnings threshold is not a fixed figure: regulation 3 defines it as the most recent average gross annual earnings recorded in the Employment Survey Report, rounded up to the nearest GBP 500, as published by Notice in the Gazette, so it moves without amending the Regulations. Permits are valid for one year (reg. 18(1)) and renew on continuing qualification, with the reg. 7(1)(d) age test disapplied on renewal. The application fee is GBP 250 and renewal GBP 20 (reg. 21). Regulation 26 repeals ss. 18 to 34 and Part IV of the Immigration, Asylum and Refugee Act, subject to the reg. 12 existing-resident and reg. 27 Withdrawal Agreement savings.
Registration as a Gibraltarian under the Gibraltarian Status Act s.9(f) long-residence limb requires continuous residence of twenty years immediately before application (amended from ten years by the Gibraltarian Status (Amendment) Act 2026, No. 27 of 2026). The Act is deemed to have come into operation on 30 October 2025. Persons who were lawfully residing in Gibraltar immediately before that date keep the prior ten-year rule under the Actโs savings provision. This is local Status registration, not British Overseas Territories Citizenship by naturalization.

Gibraltar Qualifying (Category 2) Individual tax-resident status for high-net-worth persons under the Qualifying (Category 2) Individuals Rules 2004. From the Government announcement of 18 June 2026, new applicants must show minimum net wealth of ยฃ5 million (was ยฃ2 million) and pay an application fee of ยฃ5,000 (was ยฃ1,233). Existing Category 2 certificate holders are grandfathered on the prior wealth floor. Category 2 does not confer entitlement to publicly funded schooling or healthcare; loss of Category 2 status ends the right to continue residence on that basis. Not EU free-movement status and not British citizenship.
